If a product offered by us is not as described, your sole remedy is to return it in unused condition.

Pricing and Availability

Orders

When you place an order through our Site, you are making an offer to purchase the products at the listed price. We reserve the right to accept or decline your order for any reason. After we receive your order, we will send you a confirmation email with your order details. This email serves as an acknowledgment that we have received your order and does not signify our acceptance of your order. An order is not accepted until we send you a notice confirming shipment of the product(s).

Payment

We reserve the right to remove any User Content from the Site at our sole discretion, without notice or liability.

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by LetsBonk, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Site for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials
  • You may store files that are automatically cached by your web browser for display enhancement purposes
  • You may print or download one copy of a reasonable number of pages of the Site for your own personal, non-commercial use and not for further reproduction, publication, or distribution

You must not:

  • Modify copies of any materials from the Site
  • Use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text
  • Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from the Site

Limitation of Liability

To the fullest extent permitted by applicable law, LetsBonk and its affiliates, officers, directors, employees, agents, suppliers, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Site
  • Any conduct or content of any third party on the Site
  • Any content obtained from the Site
  • Unauthorized access, use, or alteration of your transmissions or content

In no event will our aggregate liability for any claims related to the Site exceed the greater of $100 or the amounts paid by you to LetsBonk for purchases made through the Site during the three months preceding the event giving rise to the liability.

Disclaimer of Warranties

The Site and all products and services delivered to you through the Site are provided "as is" and "as available" without any warranties of any kind, either express or implied. LetsBonk disclaims all warranties, express or implied, including without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

LetsBonk does not warrant that the Site, its servers, or email sent from LetsBonk are free of viruses or other harmful components. LetsBonk will not be liable for any damages of any kind arising from the use of the Site or from any information, content, materials, products, or services included on or otherwise made available to you through the Site, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

Indemnification

You agree to defend, indemnify, and hold harmless LetsBonk, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, your User Content, any use of the Site's content, services, and products other than as expressly authorized in these Terms.

Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Indiana, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of Indiana, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.

Changes to Terms

We reserve the right to modify these Terms at any time. All changes are effective immediately when we post them and apply to all access to and use of the Site thereafter. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.

Entire Agreement

These Terms, our Privacy Policy, and any additional terms, rules, or guidelines posted on the Site constitute the entire agreement between you and LetsBonk regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
